1. Agreement Acceptance
Through accessing or engaging with ProLottoCA's educational probability demonstration platform ("Platform"), you acknowledge binding acceptance of these Terms & Conditions ("Terms"). Disagreement with these Terms prohibits Platform access or utilization.
These Terms establish a legally enforceable agreement between you and ProLottoCA, which operates under authorization from the Québec Lottery Corporation (Loto-Québec) and maintains compliance with the Québec Lottery Act (RLRQ, c. S-13.1).
2. Qualification Criteria
Platform engagement requires fulfillment of all subsequent criteria:
- Minimum age of 18 years
- Canadian residency status
- Legal capability to enter binding agreements
- Absence of exclusion through self-restriction programs or regulatory directives
- Provision of accurate and truthful registration information
We maintain the right to verify qualification at any time and may request supporting documentation.
3. Account Establishment and Protection
Registration Process
Platform engagement necessitates account creation by supplying:
- Complete legal name
- Valid electronic mail address
- Contact telephone number
- Birth date
- Residential province
Account Protection
You assume responsibility for:
- Safeguarding account credential confidentiality
- All activities conducted through your account
- Immediate notification of unauthorized access or security compromises
Account sharing with others or permitting others to utilize your account is prohibited. Each individual may establish only one account.
4. Platform Engagement
Educational Framework Access
ProLottoCA provides educational probability demonstrations through visual frameworks. To engage:
- Select a demonstration level
- Complete account verification
- Receive email confirmation of access
Engagement Guidelines
- Each demonstration provides equivalent educational value
- Access remains valid for the specified demonstration period
- Demonstration access cannot be transferred or exchanged after activation
- Access limitations may apply per individual per demonstration cycle
Demonstration Procedures
All demonstrations utilize certified visualization methods overseen by Canadian educational standards. Demonstration results serve educational purposes exclusively.
5. Intellectual Property Rights
Platform Content
All Platform content, including visual frameworks, demonstrations, text, graphics, logos, and software, remains the property of ProLottoCA or its licensors and is protected by Canadian intellectual property laws.
Permitted Usage
You may:
- Access and view Platform content for personal educational purposes
- Download and print reasonable portions for personal reference
Prohibited Activities
You may not:
- Reproduce, distribute, or publicly display Platform content without authorization
- Modify or create derivative works from Platform content
- Use automated systems to access or download Platform content
- Remove copyright or proprietary notices from Platform content
6. User Conduct Standards
Platform engagement requires adherence to these conduct standards:
- Respect other users and Platform personnel
- Provide accurate information during registration and engagement
- Comply with all applicable Canadian laws and regulations
- Refrain from attempting unauthorized Platform access
- Avoid interference with Platform operations or other users' engagement
- Not engage in fraudulent activities or misrepresentation
- Not use the Platform for commercial purposes without authorization
7. Account Termination
User-Initiated Termination
You may terminate your account at any time by contacting support@prolottoca.com. Account termination becomes effective within 48 hours.
Platform-Initiated Termination
We maintain the right to suspend or terminate accounts for:
- Terms violation
- Fraudulent activity or misrepresentation
- Failure to meet qualification criteria
- Abusive or disruptive behavior
- Prolonged account inactivity
Account termination may occur without prior notice in cases of serious violation.
8. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, whether expressed or implied. ProLottoCA does not guarantee that:
- The Platform will operate continuously or without interruptions
- Platform content is error-free or completely accurate
- The Platform will meet your specific requirements
- Any Platform defects will be corrected
ProLottoCA expressly disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.
9. Liability Limitations
To the maximum extent permitted by Canadian law, ProLottoCA shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Personal injury or property damage resulting from Platform access
- Unauthorized access to or alteration of your transmissions or data
- Third-party conduct or content on the Platform
Our total liability to you for all claims arising from Platform use shall not exceed the amount you paid for Platform access during the twelve months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless ProLottoCA, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your Platform usage or inability to use the Platform
- Your Terms violation
- Your violation of any rights of another party
- Your user content or conduct
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or Platform usage shall be resolved exclusively in the courts of Québec, Canada, and you consent to the personal jurisdiction of such courts.
12. Dispute Resolution
Informal Resolution
Before initiating formal proceedings, parties agree to attempt informal dispute resolution by contacting legal@prolottoca.com with a detailed description of the dispute.
Limitation Period
Any claim or cause of action arising from Platform usage must be filed within one year after the claim or cause of action arose, or such claim shall be permanently barred.
13. Terms Modifications
ProLottoCA reserves the right to modify these Terms at any time. Material modifications will be communicated through Platform notifications or email at least 30 days before the effective date. Continued Platform usage following modification constitutes acceptance of the revised Terms.
14. Severability
If any Terms provision is deemed invalid, illegal, or unenforceable, such provision shall be modified to achieve the intended economic effect to the greatest extent possible, and the remaining provisions shall continue in full force and effect.
15. Entire Agreement
These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ProLottoCA regarding Platform usage and supersede all prior agreements and understandings.
